TERMS & CONDITIONS
Thank you for choosing Mzanzi Soundworx. We are committed to delivering a professional, reliable, and memorable entertainment experience. The following Terms & Conditions form part of the agreement between Mzanzi Soundworx (“the Company”) and the Client.
1. Booking Confirmation
A 25% non-refundable reservation fee is payable upon acceptance of the quotation.
A booking is only confirmed once the reservation fee has been received.
The reservation fee secures your event date and will be deducted from the total quoted amount.
2. Final Payment
The remaining balance must be paid in full no later than 7 (seven) days before the event date.
Failure to make payment by the due date may result in cancellation of the booking.
3. Cancellation Policy
The Client may cancel the booking by providing written notice.
Should the Client cancel the booking for any reason other than a Force Majeure event (including natural disasters or government restrictions), the reservation fee shall remain non-refundable.
If cancellation occurs less than seven (7) days before the event, Mzanzi Soundworx reserves the right to recover any additional costs already incurred.
4. Overtime
The agreed performance times are stated in the quotation.
Should the Client request additional entertainment beyond the agreed finish time, overtime will be charged at the hourly rate specified in the quotation.
Overtime is subject to the DJ’s availability and venue approval and is payable before the commencement of the extended performance.
5. Replacement DJ
In the unlikely event that the allocated DJ becomes unavailable due to illness or other unforeseen circumstances, Mzanzi Soundworx will provide a suitably qualified replacement DJ of comparable experience at no additional cost.
6. Force Majeure
Mzanzi Soundworx shall not be held liable for delays, interruption or non-performance caused by circumstances beyond our reasonable control, including but not limited to:
• Severe weather
• Flooding
• Fire
• Road closures
• Traffic accidents
• Civil unrest
• Acts of terrorism
• Government restrictions
• National disasters
• Load shedding affecting the venue
• Any other unforeseen event beyond our reasonable control
7. Venue Access
The Client agrees to ensure that suitable access to the venue is available for loading, setup and dismantling.
A minimum of 90 minutes before the performance and 90 minutes after the performance may be required depending on the equipment booked.
8. Electrical Supply
The Client shall ensure that the venue provides safe, reliable electrical power suitable for professional entertainment equipment.
Mzanzi Soundworx cannot be held responsible for interruptions caused by inadequate or faulty electrical supply.
9. Client Responsibilities
The Client is responsible for ensuring that guests conduct themselves appropriately throughout the event.
Venue management should provide suitable supervision where necessary.
10. Abuse & Unsafe Behaviour
Verbal abuse, threatening behaviour, violence or intimidation directed towards any member of Mzanzi Soundworx will not be tolerated.
Should such behaviour occur, Mzanzi Soundworx reserves the right to terminate services immediately without refund.
11. Damage to Equipment
The Client accepts responsibility for any loss of or damage to Mzanzi Soundworx’s equipment, vehicles or personal property caused by the Client, guests, venue staff or contractors.
The Client may be held liable for repair or replacement costs where applicable.
12. Performance Times
Performance start and finish times are those confirmed in the accepted quotation.
Any variation remains at the sole discretion of Mzanzi Soundworx and may attract additional charges.
13. Working with Other Suppliers
Where Mzanzi Soundworx is required to perform alongside live bands, musicians or other entertainers, the Client shall ensure that:
• Adequate performance space is available.
• Separate electrical power outlets are provided.
• Sufficient setup time is allocated for all service providers.
14. Travel Charges
Travel outside the standard service area will be charged in accordance with current Automobile Association (AA) rates, as specified in the quotation.
15. Outdoor Events
Where entertainment is provided outdoors, the Client shall ensure suitable protection against rain, excessive heat, dust and adverse weather conditions.
Mzanzi Soundworx reserves the right to suspend or discontinue services where equipment or personnel may be placed at risk.
16. Photography & Marketing
Unless otherwise requested in writing, Mzanzi Soundworx reserves the right to use photographs and short video clips taken during the event for marketing, portfolio, website and social media purposes.
No personal information will be disclosed.
17. Privacy
Mzanzi Soundworx is committed to protecting the privacy of its clients.
Personal information will be processed in accordance with the Protection of Personal Information Act (POPIA) and will only be used for purposes relating to your booking.
18. Governing Law
These Terms & Conditions shall be governed by the laws of the Republic of South Africa.
19. Acceptance
Payment of the reservation fee constitutes acceptance of these Terms & Conditions.
